What You Should Know Before You Hire a Social Security Disability Lawyer

The requirements for social security disability benefits can be confusing for the average person to understand enough to successfully file a claim and get the benefits they deserve. The process is so complex that many disabled people hire a Social Security Disability lawyer to help them file their claim, appeal rejections and get their monthly checks started.

Work Credits
This is one of the most confusing requirements. Each worker can earn up to four credits every calendar year. Credits are based on income earned from self-employment or wages and most people need 40 credits to qualify for SSD. In addition to earning a total of 40 credits, you’ll need to have earned 20 credits in the past 10 years. However, if you are 31 or younger when you become disabled, you may be able to qualify for benefits with fewer work credits.

Disability
In order to qualify for SSD, you need to either have one of the conditions on the Social Security Administration’s list of disabling conditions or be able to prove that your condition is so severe that you are unable to work in any capacity. While those with a medical condition on the list are likely to receive benefits without having to go through a lengthy appeals process, you may have a harder time convincing the Social Security Administration that you meet the qualifications for benefits. You must be unable to work for more than one year to qualify.

Whether you hire a Social Security Disability lawyer to help you complete your application for benefits or you consult with an attorney after your claim has been denied, your lawyer will fight for your right to benefits. There is no risk in working with an experienced disability attorney before you file your claim because they won’t charge you a fee unless they are able to secure benefits on your behalf. Initial consultations are typically complimentary. Attorneys such as Shinbaum & Campbell P.C. have the knowledge, skills and experience to help you understand your rights and stand by your side as you fight for the disability benefits you paid for while you were working.
